Lynx Bus Crash: Silver Star Road Reopened

Silver Star Road in Orlando, Florida has been reopened after a motor vehicle crash involving a Lynx Bus.  The accident happened at approximately 9:50 a.m. on Silver Star Road near North Powers Drive.  Five people were sent to the hospital.  The accident closed westbound lanes.

Common carriers, such as Lynx, have a heightened duty to passengers to avoid injury.  This elevated standard is essentially one of strict liability for injuries that occur on the common carrier's vehicle.  However, Lynx is likely created by a governmental entity and would enjoy sovereign immunity.  This fact alone could make the claims of the injured passengers very difficult.  Claims against the government require a special pre-suit notice and have limitations such as a damages cap with a maximum limit of 25% that can be charged by an attorney on a contingency fee.  The contingency fee is a financial arrangement that allows persons who could not otherwise afford to hire a lawyer to pay the lawyer out of any financial recovery that is made.  In such contingency fee agreements, if there is no financial recovery, then generally speaking the claimant owes nothing to the attorney.
