A medical shuttle and an SUV were involved in a car accident on July 7, 2010 near Daytona Beach, Florida.  The accident occurred around 4:30 p.m. near the intersection of Fairview Avenue and Segrave Street.  The medical shuttle hit the SUV.  The was driving the SUV was pulled by rescuers from the wreckage and taken to Halifax Medical Center in serious but stable condition.  The shuttle driver had minor injuries was taken to a hospital.  Police are still investigating this accident.

In this case, the medical shuttle will likely be considered a common carrier under Florida law.  As such, common carriers have a higher duty of care for the passengers that they carry.  This means that they must do more than the average person to protect against injury or death.  Thus, the passengers on the common carrier may have claims against the medical shuttle.  The woman driving the SUV, however, has only a negligence claim against the shuttle driver and the common carrier.  From the article, it appears that the shuttle driver was negligent.  Therefore, the woman driving the SUV has a viable negligence claim against the shuttle driver and common carrier for her significant injuries.  Central Florida personal injury lawyers with Moody Law represent those injured in car accidents due to the fault of another person.  Our Central Florida personal injury lawyers can meet with you and discuss the particular facts and circumstances of your accident or injury case.  A consultation with one of our Central Florida personal injury lawyers is free.
