FedEx Truck and Van Involved in Fatal Accident
This accident involved a minivan and a FedEx truck. The accident happened at approximately 9:00 p.m. Monday night near the intersection of Crenshaw Street and Anderson Road. The driver of the FedEx truck was taken to St. Joseph's Hospital and the driver of the minivan was pronounced dead. This accident is still under investigation.
While this accident is still under investigation and the facts may determine the outcome, the way for the family of the deceased to approach this case is to view from a worst case scenario perspective. If the authorities determine that there is fault on behalf of the minivan driver, this very well can and perhaps should be a wrongful death case with comparative negligence. In Florida, contributory negligence is not a complete bar to recovery as it was many years ago. As such, the current state of the law is that the negligence of each party involved is weighed by the jury and assigned a percentage of fault for each respective vehicle. The damages are multiplied by the percentage of fault and awarded in that manner. Thus, there is very likely something that the driver of the FedEx truck could have done differently under the circumstances in order to avoid the accident or reduce the impact of the accident. That is why the family of the deceased should seek legal counsel and evaluate this case for liability. Again, the actual determination of liability will be based on the facts rather than commentary in blogs such as this one.
