Lakeland Woman Dies Following Kathleen Road Accident
Lakeland, Florida. On September 22, 2012, Ruth A. Paff was involved in a motor vehicle accident as John E. Fuoss, 19, made a left turn at the intersection of Sleepy Hill Road and Kathleen Road. Fuoss's vehicle struck the front of Paff's vehicle. Fuoss was cited for failure to yield. Paff was 76 at the time of the crash and was taken to Lakeland Regional Medical Center.
This accident appears to be the result of Fuoss's negligence from information in the news media. Regardless of whether Mr. Fuoss simply made a bad decision or was distracted by something, he is likely legally responsible for this crash and resulting wrongful death of Ms. Paff. Ms. Paff's survivors have a right to bring a wrongful death action through a personal reprentative established by a probate court. Even if there is a pre-suit settlement of this matter, a personal representative must still be appointed by the probate court in order to have full and final binding authority to settle the liability claim. This is sometimes a simple matter and sometimes a more complicated matter.
