The intoxicated driver was arrested and faces criminal charges. Do I need to file my own lawsuit?
Yes. The criminal courts are focused on determining the other driver's guilt and the appropriate punishment. A civil case is focused on your losses and determining how much restitution the other party owes you.
The driver's insurance company called and offered a great settlement. Can I just accept it and skip filing a lawsuit?
You can, but we don't recommend it. Insurance companies are businesses like any other, and they are focused on making money. They have everything to gain by offering you less than what your claim is really worth, so don't accept any offer until you consult an attorney. Moody Law can negotiate on your behalf, and take your case to court if an agreement can't be reached.
The other driver was drinking in a bar right before the accident. Can I sue the bar?
Possibly, but this type of liability is uncommon. Florida grants bars, restaurants, and social hosts more leniency than some other states, and will only hold them liable if they served someone who is underage or someone they know is addicted to alcohol.
